Responsible Care® Partnership Program
Union Tank Car Company participates in Responsible Care® as a Partner. Partner companies must implement a Responsible Care Management System® (RCMS) to meet the same obligations as member companies. In doing so, Partner companies enhance their product stewardship and outreach activities throughout the supply and distribution chain.
The Partnership Program is open to companies that have direct and substantial involvement in the manufacture, use, formulation, distribution, transportation, storage, treatment-disposal and/or sales and marketing of chemicals.

Responsible Care Management System®
The UTLX Management System consists of the following five (5) technical specifications.
The UTLX RCMS is composed of five basic components. These components are designed much like a quality management system with the ultimate goal of continual improvement. The first and most important of all these components is management's commitment to becoming a Responsible Care® Partner.
The remaining four components complete the continual improvement cycle of Planning, Implementing (Do), Measuring (Check), and Review (Act).

Measure Purpose
To document the extent and breadth of outreach efforts to key stakeholders including communities, regulatory agencies, and other groups impacted and served by the Equipment Supplier- Container Responsible Care® Partner and to demonstrate their commitment to meet the informational needs of all stakeholders.
The general public is concerned with the safety of containers used for chemical transportation traveling in their communities. To meet the need for open and honest dialogue with these groups all equipment Supplier- Container Responsible Care® Partner companies participate in emergency response drills and exercises, customer/shipper product safety training, and community outreach programs to emphasize safety, security, and environmental protection.

Performance Measure
OSHA Total Recordable Case Rate for Employees and Contractors
Measure Purpose
To help track and identify workplace problems and/or progress made in preventing work-related injuries and illnesses.
Incidence rates are used to evaluate a company's injury and illness experience over time to compare the company's experience with that of the industry as a whole. This incidence rate is the number of recordable injuries and illnesses including deaths, days away from work, restrictions, and other recordable cases occurring for each 100 full-time employees per year, based on 2,000 hours worked per employee per year.
This measure will provide ACC members, Responsible Care® Partners and other interested parties with annual information on employee health and safety performance.

Product Failure Incident Rate
Performance Measure
Frequency rate of DOT Form 5800 regulated product release incidents (as reported to the DOT by end container user) divided by total number of single use containers produced plus repeat use containers currently in service.
Measure Purpose
This measure provides insight into the continuous improvements made by the container manufacturing or leasing company to ensure product integrity and quality and the industry sector as a whole to prevent accidents and chemical releases. The product failure frequency rate for each ES-CC would be expected to decrease as the ES-CC improves quality and implements design or production changes to address identified problems.

Responsible Care® Certification
Responsible Care® Certification Status
The ES-CC company will report to ACC information regarding the completion of their Responsible Care® certification. This will include the date of the certification, location of the certification, type of certification, and third-party certification firm. The deadline for the first certification cycle is December 31, 2007.
Union Tank - Corporate Headquarters received its RCMS certification on June 11, 2007. We are currently working on obtaining certification for our manufacturing and repair sites as required. We anticipate receiving certification by Dec. 31, 2007.
Security
Security Code Implementation Status
The ES-CC company will report to ACC information regarding the implementation of the Responsible Care® Security Code. Reporting will be managed through the required submittal of Security Code Progress Reports.Union Tank has fully implemented the Security Code.
